INTERIM GUDIANCE TO BREEDERS WITH RESPECT TO THE MARCH 17TH LETTER FROM APHIS
BACKGROUND: If breeders do not seek a court ordered injunction by April 1, 2011 that would prohibit the release of information to the HSUS, the USDA plans to release the information to the HSUS on April 4, 2011. I am exploring the feasibility of filing for an injunction, and how the expenses for such a filing will be addressed. Hopefully, I will have more information on that action no later than Tuesday. In the meantime, I recommend that all breeders complete the checklist actions discussed below - - NO LATER THAN SATURDAY. The documents discussed below would be used for back up to support why a Court should issue an injunction, and they need to be done immediately so that they could be attached to a Court Petition and used to the justify to the Court why it should enjoin the USDA from releasing information to the HSUS.
1. AFFIDAVIT:
· Breeders need to add their name, address, USDA License Number, and the date you received the APHIS Letter in the blanks on the Affidavit. (Can be done with pen and ink.)
· Make a total of four copies of the Affidavit, and have each copy notarized before a Notary. Often this can be done at a local bank for no charge if the breeder has an account with the bank.
· Keep one copy for your records.
· Mail the other three notarized copies to Franklin W. Losey, 2029 Tampa Blvd., Navarre, FL 32566. If at all possible, mail those copies by Priority Mail No Later Than Saturday, so that I will receive them either on Monday or Tuesday at the latest.
2. E-MAIL OR LETTER TO THE FBI:
· Add your name, address and phone number to the boilerplate notice to the FBI.
· Send the E-Mail or Letter to the FBI Offices in St. Louis AND Kansas City. (stlouis@ic.fbi.gov and Kansas.city@ic.fbi.gov)
o I recognize that some had their prior E-Mails to the FBI rejected as unopened and deleted. Still do it, and if you receive such an E-Mail response, E-Mail that rejection to f.losey@insightbbb.com .
· Use the wording on the attached for the E-Mail or Letter to the FBI. If you do not have E-Mail access, send the letters to the following addresses:
o FBI, 1300 Summit Street, Kansas City, MO 64105.
o FBI, 2222 Market Street, St. Louis, MO 63103.
3. I anticipate that by Tuesday I will be sending a follow-up for breeders that will include a suggested response to the APHIS Letter dated March 17, 2011.
4. Everybody keep their cool. This just may be the straw that will cause the FBI to seriously consider investigating the HSUS.
